In any case I cannot but feel that the ensurance of a final decision in regard to these cases should not be any further prolonged and should Your Excellency be of opinion that in consequence of the restricted number of the cases under discussion they can be more properly treated in this capital, I shall have great pleasure in placing myself at an early date at Your Excellency's disposal for their discussion and examination.

I avail myself of this opportunity to renew to Your Excellency the assurance of my highest consideration.

Senhor Ministro, - Tive a honra de dirigir-me a Vossa Excellencia, em 13 de maio ultimo a respeito da reclamação de Philip Maxwell por gado e cavallos tomados pelas forças legaes durante a insurreição no Rio Grande e da apprehensão de seu filho em circumstancias semelhantes. Tambem o Encarregado de Negocios de Sua Magestade transmittiu-lhe em 9 de agosto novos documentos em apoio do caso, recorrendo além disso a Vossa Excellencia quanto ás penosas circumstancias em que desappareceu o joven Maxwell.

A unica communicação recebida de Vossa Excellencia em resposta tem a data de 14 de maio e diz que este assumpto tinha sido passado ao Ministerio da Guerra para informação.

Como Sua Excellencia não tem annuido ao vosso pedido de explicações, é meu dever chamar com urgencia a attenção de Vossa Excellencia para este caso em cuja solução toda demora causará serios prejuizos ao Sr. Maxwell.

Posso accrescentar que, segundo me consta, casos semelhantes provenientes de circumstancias identicas foram levados ao conhecimento

da Repartição a cargo de Vossa Excellencia pela Legação Italiana e submettidos em Porto Alegre ao exame de uma commissão mixta de cujos trabalhos resultou apropriada reparação aos reclamantes.

Estou certo de que o Governo Federal não recusará egual exame imparcial de casos em que estão envolvidos interesses de reclamantes Britannicos e animo-me a suggerir que este caso, como o de William Dale (a cujo respeito a ultima communicação de Vossa Excellencia tem a data de 9 de Janeiro de 1897) seja submettido a um tribunal semelhantemente constituido.

Em todo caso penso que a segurança de uma decisão final destes casos não póde soffrer maior demora, e, si Vossa Excellencia for de opinião que os casos em discussão, por serem de numero restricto, podem ser mais propriamente tratados nesta capital, terei muito prazer em pôr-me á sua disposição em proxima data para discutil-os e examinal-os.

Aproveito esta opportunidade para renovar a Vossa Excellencia a segurança da minha mais alta consideração.

Tenho presente a nota que o Sr. C. Phipps, Enviado Extraordinario, e Ministro Plenipotenciario de Sua Magestade Britannica, serviu-se dirigir-me a 17 do mez passado, recordando a solução da reclamação de Philip Maxwell, que se queixa da tomada de gado

de sua propriedade por forças legaes e do desapparecimento de seu filho, durante a revolução no Estado do Rio Grande do Sul.

Alludindo á Commissão Mixta de Porto Alegre, á qual foram submettidas reclamações similares de subditos Italianos, o Sr. Ministro suggere a idéa de serem julgadas por forma identica a do referido Maxwell e a de William Dale.

O Governo Federal desejaria ser agradavel ao Sr. Phipps, mas sente não poder concordar com a sua indicação, visto qué a resolução tomada com referencia aos subditos Italianos teve um caracter todo especial e foi aconselhada pelas circumstancias do momento. Entretanto, já pedi ao Ministerio dos Negocios da Guerra informações sobre o caso de William Dale, e vou tambem solicital-as quanto ao de Philip Maxwell, cabendo-me dizer ao Sr. Phipps que os documentos relativos a este estão dependentes de exame do Commandante do 6o districto Militar, e que o citado Ministerio communicou-me convir que o reclamante apresente, para justificar o seu direito, os documentos originaes devidamente sellados e declare a importancia em que calcula a sua reclamação.

Aproveito a opportunidade para reiterar ao Sr. Ministro as seguranças da minha alta consideração.

Monsieur le Ministre I have the honour to acknowledge the receipt of Your Excellency's note of the 23rd instant stating the grounds

upon which the Federal Government is unable to accept my suggestion that the cases of W. Dale and P. Maxwell (whose property was seized by the legal forces during the Rio Grande Revolution) should be submitted to the decision of a Tribunal constituted similarly to that which adjudicated on the claims of Italian subjects which were identic in character.

Your Excellency however informs me that you have already asked the Minister of War for a report on the case of Dale and that you were about to do so with regard to that Maxwell, and further that since this latter case was dependent upon the result of an examination on the part of the commandant of the 6th Military District it would be necessary that the original documents, duly stamped would be submitted, as well as a statement of the amount at which Maxwell sets his claim. With regard to the latter point I would remind Your Excellency that the amount of Maxwell's claim was supplied in his « Statement of claim» dated 27th of march 1897 wich accompaned my note of the 3rd of May last and reached a total of 49:680$000.

I also do myself the honour to enclosing the original documents enumerated as follows.

2-Letter from Mr. P. Maxwell (dated 11th february 1897) together with reply from General Menna Barreto admitting the seizure of horses and cat'le in Mr. Maxwell's breeding establishment.

3-Declaration of Mr. Maxwell (dated 17th february 1897) as to number of cattle and horses seized together with signatures of witnesses testemunhas do occorrido. »

4- Declaration of neighbours (dated 10th june 1897) as to Mr. Maxwell's character and as to the seizure of his property and disappearence

of his son.

I may add that I have instructed Mr. Vice-consul Archer at Porto Alegre to endeavour to supply any further information or particular that may be required by the commandant of the 6th Military District.

Whilst requesting that Your Excellency will be so kind as to acknowledge the receipt of the original documents herewith enclosed, I venture to repeat the hope which I expressed to Your Excellency on the 23th instant that no time may be lost in examining the case of Maxwell who has resided thirty five years in this country, and who is, I am informed, in distressed circumstances.

I avail myself of this opportunity to renew to Your Excellency the assurance of my high consideration.
