Nota do Governo Brasileiro á Legação Britannica.

Rio de Janeiro, Ministerio das Relações Exteriores, 14 de Maio de 1897.

Tive a honra de receber a nota, acompanhada de cinco documentos, que o Sr. C. Phipps, Enviado Extraordinario e Minist ro Plenipotenciario de Sua Magestade Britannica, dirigio-me a 3 do corrente, patrocinando a reclamação do subdito do seu Paiz Philip Maxwell, que se queixa de The haverem as forças legaes, durante a revolução no Estado do Rio

Grande do Sul, não só tomado muitas cabeças de gado de sua propriedade, mas ainda aprisionado um seu filho de 14 annos de idade, do qual não tem tido noticia desde então.

Hoje levo o caso ao conhecimento do Ministerio da Guerra, pedindolhe que me habilite, com os esclarecimentos precisos, a responder ao

Sr. Phipps.

Aproveito a opportunidade para reiterar ao Sr. Ministro as seguranças da minha alta consideração.

Monsieur le Ministre,- With reference to Mr. Phipp's note of 3 may last respecting the seizure of a large number of horses and cattle belonging to a British subject named Philip Maxwell and the disappearance of this infortunate man's son I have the honour to inclose further official copies of documents, of which the originals are in my possession, in support of his claim to compensation.

The further evidence now inclosed coupled with the evidence inclosed in Mr. Phipp's above mentioned note is surely complete and I cannot doubt that the Brazilian Government will be ready to do what it can to alleviate Mr. Maxwell's sorrow by paying to him due compensation for the losses he incurred at the hands of the Federal Troops.

In a letter Mr. Maxwell describes himself as prematurely aged and broken down in health owing to the loss of his son for whom he has made fruitless search for over 3 years.

I therefore beg Your Excellency to use every endeavour to obtain payment of this claim made by a British subject against whom no charge has ever been brought, who enjoys the respect of all his neighbours, who produces conclusive proof that he has sustained great losses and who has in addition endured the terrible sorrow caused by the disappearance of his much-loved son.

I avail myself of this opportunity to renew to Your Excellency the assurance of my highest consideration.

Senhor Ministro,- Referindo-me á nota do Sr. Phipps de 3 de maio. ultimo, relativa a um grande numero de cavallos e gado de propriedade do subdito Britannico chamado Philip Maxweli e ao desapparecimento do filho deste infeliz homem, tenho a honra de incluir em apoio do pedido de indemnisação mais cópias officiaes de documentos cujos originaes estão em meu poder.

A prova addicional agora annexa e a incluida em a nota do Sr. Phipps acima citada são seguramente completas e eu não posso duvidar que o Governo Brazileiro esteja disposto a fazer o que puder para alliviar a magua do Sr. Maxwell pagando-lhe uma compensação pelas perdas que as Tropas Federaes lhe causarão.

O Sr. Maxwell descreve-se em uma carta como prematuramente velho e de saude arruinada em consequencia da perda de seu filho que em vão tem procurado durante mais de tres annos.

Peço portanto a Vossa Excellencia que faça toda diligencia para obter o pagamento desta reclamação de um subdito Britannico, contra o qual nenhuma accusação se tem feito, que gosa do respeito de todos os seus visinhos, que prova concludentemente ter soffrido grandes perdas e que além disso tem supportado a terrivel magua causada pelo desapparecimento de seu muito amado filho.

Nota da Legação Britannica ao Governo Brazileiro

British Legation - Rio de Janeiro 17th January 1898.

Monsieur le Ministre, I had the honour of addressing Your Excellency on the 3rd of May last, relative to the claim of Philip Maxwell on account of cattle and horses seized by the legal forces during the Insurrection in Rio Grande and in regard to the seizure, under similar circumstances, of his son. Her Majesty's Chargé d'Affaires also, on the 9th of August transmitted further documents, in support of the case, making moreover an appeal to Your Excellency in respect to the painful circumstances under which Young Maxwell disappeared.

The only communication which has been received from Your Excellency in reply was dated the 14th of May and stated that the matter had been referred to the Minister of war for a report.

As His Excellency has failed to comply with your request to afford the desired explanations it is my duty urgently to recall Your Excellency's attention to the case, the delay in the settlement of which involves serious prejudice to Mr. Maxwel.

I may add that I understand that similar cases arising out of identical circumstances, and which were brought to the notice of Your Excellency's department by the Italian Legation, have been submitted to the examination of a mixed commission at Porto Alegre, the labours of which have resulted in the assignment of suitable reparation to the claimants.

I feel confident that the Federal Government will not refuse an equally impartial examination of cases in which the interests of British claimants are at issue, and I venture to suggest that this case as well as that of William Dale (in regard to which Your Excellency's last communication was dated the 9th of January 1897) should be submitted to a similarly constituted tribunal.
