An Act for the more effectually detaining in
cuftody Napoleon Buonaparté.

I.

(11the April 1816.)

Whereas it is necessary for the Preservation

of the Tranquillity of Europe, and for the general Safety, that Napoleon Buonaparté fhould be detained and kept in Cuftody as is herein after provided: Be it therefore enacted: ad it is hereby enacted by the Kings moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the Same, That it fhall and may be lawful for his Majefty, his Heirs and Successors, to detain and keep the Said Napoleon Buonaparté in the Cuftody of fuch Perfon or Perfons, in fuch Place within his Majestys Dominions, and under fuch Restrictions, during the Pleasure of his Majeftys, his Heirs and Succeffors, as to his Majesty, his Heirs and Succeffors fhall from Time to Time feem fit.

II. And be it further enacted, that the faid Napoleon Buonaparté being in fuch Custody as aforesaid, Nouveau Recueil. T. III.

1816 fhall be deemed and taken to be, and shall betreated and dealt with as a Prisoner of war, except only in fo far as by his Majefty, his Heirs and Succeffors, fhall at any Time, or from Time to Time, be otherwise directed, and that it fhall and may be lawfull for his Majefty his Heirs and Succellors by Warrant under the Hand and Seal of one of His or their Principal Secretaries of State, to nominate and appoint fuch Perfon or Perfons, being his Majefty's Subject or Subjects, as to his Majefty, his Heirs, and Succeffors fhall seem fit, to have the Cuftody of the faid Napoleon Buonaparté and from Time to Time, by like Warrant to change the Place, and to appoint fuch other Place, as to his Majefty his Heirs and Succeffors fhall feem fit, the Cuftody of the faid Napoleon Buonaparté: in which the said Napoleon Buonapaité from the Place in which he now is, or fhall at any Time hereafter be so detained and kept, and to convey him to fuch other Place as shall be fo appointed as aforefaid; and that it shall and may be lawfull for fuch Perfon or Perfons fo appointed or to be appointed as aforefaid, to call to his or their Aid and Assistance all or any Persons, being Subjects of his Majefty, or owing Allegiance to his Majefty, for the detaining and keeping the faid Napoleon Buonaparté in Cuftody as aforefaid, or for the removing or conveying him as aforefaid, as Occafion may require: and that all and every fuch. Perfon or Persons fo appointed as aforefaid; and all and every Perfon and Perfons, who shall be called to his or their Aid and Assistance, shall have full Power and Authority to use all Ways and Means for the detaining and keeping the said Napoleon Buonaparté in fuch Cuftody and for the Prevention of the Rescrue or Elcape, of the faid Napoleon Buonaparté from and out of fuch Cuftody, and for the retaking the faid Napoleon Buonaparté in Cafe he fhall be rescued or fhall efcape from and out of the same, as might be lawfully used for the detaining and keeping in Custody, and for preventing the Rescrue or Efcape of, and for retaking any Prisoner of war.

III. And be it further inacted, that if any Person or Perfons, being a Subject or Subjects of or owing Allegiance to his Majefty, his Heirs or Succeffors, shall rescue or attempt to rescue the faid Napoleon Buona

parte, or fhall knowingly and willfully aid or affift 1816 in the Efcape of the faid Napoleon Buonaparté, or in any Attempt to escape from fuch Cuftody as afore faid, or from any Limits or Bounds wherin he now is or at any Time hereafter fhall or may be detained and kept in Cuftody as aforesaid, or in which he shall or may be fuffered to go at Large within the Limite of any Island or Country, Territory or Place, or within the Limite of any District or Bounds within any Iftand or Country, Territory or Place, upon Parole or without Parole, all and every fuch Perfon or Perfons fo offending, fhall upon being convicted thereof be adjudged guilty of felony, and fhall fuffer Death as in Cafes of felony, without Benefit of Clergy.

IV. And be it further enacted, that if any Perfon or Perfons, being Subjects of or owing Allegiance to his Majefty his Heirs or Succellors, fhall knowingly and wilfully aid, affift, or further the faid Napoleon Buonaparte in quitting any Part of any Ifland, Country, Territory, or Place, within which he may have been confined or suffered to go at Large, on Parole or without Parole, after he shall have been rescued, or have escaped or departed from any place of cuftody or from the Limits and Bounds within which he shall have been committed to go at Large, upon Parole or without Parole, he, fhe or they fhall be deemed guilty of aiding the Escape of the faid Napoleon Buonaporté, under the Provisions of this Act.

V. And be it further enacted, that if any Perfon or Perfons being a Subject or Subjects of his Majesty, or owing Allegiance to his Majefty, after the faid Napoleon Buonaparté fhall have been refcued or have esca ped or departed from and have quitted the Island, Country, Diftrict or Territory, within which he fhall have been detained and kept inCuftody as aforesaid or have fuffered to go at large, upon parole or without, or after he fhall have quitted and departed from any other Country into which he may have efcaped or come, fhall knowingly and willfully upon the high Seas, aid, allift or further the faid Napoleon Buonaparté in efcaping or going to or towards any other Dominions or Place whatsoever fuch Perfon or Persons shall be ad
