GRANTING SIX MONTHS' PAY TO MARIA J. McSHANE (H. R. 15990)

MY DEAR MR. CHAIRMAN: Replying further to the committee's letter of January 7, 1927, transmitting the bill (H. R. 15990) granting six months' pay to Maria J. McShane, and requesting the views and recommendations of the Navy Department thereon, I have the honor to advise you as follows:

The records of the Navy Department show that Ensign Julian J. McShane was drowned at Wilmington, Calif., on October 9, 1926. He graduated from the Naval Academy in June, 1925, and at the time of his death was attached to and serving on board the U. S. S. Tennessee. Although it is understood that in fact his mother, Maria J. McShane, named in the bill, was dependent upon him, he had neglected to fill out the beneficiary slip and consequently the records are not sufficiently complete to permit the legal payment of the usual six months' pay to dependents in the event of death of the officer. This bill covers this defect and permits the payment of the six months' gratuity to McShane's dependent mother.

Bill H. R. 15990 will, if enacted into law, result in an additional cost to the Government of $750.

The bill H. R. 15990 was referred to the Bureau of the Budget with the above information as to cost and a statement that the Navy Department contemplated making a favorable recommendation thereon. Under date of January 28, 1927, the Director of the Bureau of the Budget advised the Navy Department that this report would not be in conflict with the financial program of the President. In view of the foregoing, the Navy Department recommends that this bill be enacted.

A BILL Granting six months' pay to Maria J. McShane

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That there is hereby authorized to be appropriated out of any money in the Treasury not otherwise appropriated, such sum as may be necessary to pay Maria J. McShane, dependent mother of the late Ensign Julian J. McShane, United States Navy, an amount equal to six months' pay at the rate said Julian J. McShane was receiving at the date of his death.

MY DEAR MR. CHAIRMAN: With reference to the bill (H. R. 15120), to amend the act approved June 1, 1926 (Public, No. 318 69th Cong.), authorizing the Secretary of War to exchange deteriorated and unserviceable ammunition and components, and for other purposes, I have the honor to recommend that the bill be amended so as to confer similar authority upon the Secretary of the Navy by adding an additional paragraph at the end thereof reading as follows:

That the authority herein conferred on the Secretary of War is hereby extended to include the Secretary of the Navy.

The reason for this proposed amendment is that the Navy Department believes such a law would be of considerable advantage in the matter of replacing deteriorated and unserviceable ammunition and components thereof belonging to the Navy.

There is no data available upon which an estimate can be based as to the cost of this proposed legislation so far as concerns the Navy Department.

The proposed amendment was referred to the Director of the Bureau of the Budget with the information that the Navy Department contemplated recommending its addition to the bill H. R. 15120, and, under date of January 25, 1927, the Navy Department was advised that this proposed legislation is not in conflict with the financial program of the President.

The attention of the committee is invited in this connection to the bill S. 4692 (which is identical with H. R. 15120), which has been favorably reported out by the Committee on Military Affairs of the Senate.
